1. Notice of Claimed Infringement Requirements

If you are a copyright owner, or are authorized to act on behalf of one, and believe in good faith that any content or musical message hosted on Typatone infringes upon your copyright, please submit a formal written DMCA notice containing the following mandatory elements:

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and that is to be removed or access to which is to be disabled, including the exact URL (e.g., https://www.typatone.org/m/message-id) or specific reference so that we can locate the material.
  4. Contact Information: Information reasonably sufficient to permit Typatone to contact the complaining party, such as an address, telephone number, and an email address.
  5. Statement of Good Faith: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Statement of Accuracy Under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Action Upon Receipt of Notification

Upon receipt of a valid and complete DMCA takedown notice, Typatone will expeditiously:

  • Remove or disable access to the identified infringing message or material.
  • Notify the user who posted the material that access has been removed or disabled.
  • Provide the user with a copy of the takedown notice, informing them of their right to submit a Counter-Notification under the law.

3. Counter-Notification Procedure

If you believe that your composition was removed or disabled as a result of mistake or misidentification, you may send a written Counter-Notification to our Designated Agent containing:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the competent court for the judicial district in which your address is located (or in Jharkhand, India, if your address is outside India), and that you will accept service of process from the person who provided the original takedown notice.

If a valid Counter-Notification is received, we will forward a copy to the original complaining party. If the complaining party does not notify us within 10-14 business days that they have filed an action seeking a court order against the user, we may restore access to the removed material.

4. Repeat Infringer Policy

In accordance with Section 512(i)(1)(A) of the DMCA, Typatone maintains a strict policy to terminate user access, IP allowances, or compositions associated with repeat copyright infringers in appropriate circumstances.

5. Warning Against False or Misleading Claims

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed by mistake or misidentification, may be subject to substantial liability for statutory damages, court costs, and attorneys' fees.
